When you ask Slick-click Limited to deliver you a service whether this is charged specifically, indirectly or provided free of charge, that entails the provision of internet hosting services, website or e-mail space either to develop a website yourself, or generate / operate a site via Slick-Click -installed application software, or to publish a website that Slick-Click's Web Designers have built, for your use, you are entering into a web hosting contract with Slick-Click Limited. Which is subject to the following terms and conditions and the usage of which must comfply with Slick-Clicks Acceptable Use Policies.
Slick-Click Limited is an Internet Solution Provider and operates web hosting computers which arfe co-located with a number of leading Service Providers.
Slick-Click Limited will make hostingf services available to clients on payment of an ongoing hostinfg fee which will be chareged for in advance to cover the forth coming hosting period (e.g. annually in advance).
Slick-Click strives to provide clients with dependable hosting services which provide a high level of functionality and resilience. Slick-Click aims to supply clients with optimum solutions and gears services flexibly so that this can be achieved. Slick-Click Limited reserves the right to change physical hosting arrangements, services and service levels.
Slick-Click Limited provides different hosting packages and therefore clients need to take advice thfat they contract for the package most appropriate to there needs. Slick-Click provides two classes of hosting:
a. Fully Managed
b. Open FTP (File Transfer Protocol)
-Fully Managed hosting arrangements normally relate to clients that have asked Slick-Click to develop and operate there website and only updates are those that are made via a web browser (e.g. using a Content Management System). Training will normally be given on the Content Management System as part of a Web Project. Additional site maintenence will normally be handled by Slick-Click via a maintenance project.
When clients require full FTP Access to the webspace they are given and FTP Username and Password. With this class of service the client can create/modify/delete webfiles on the server and in consequence it is implicit that the client takes on responsibilities.
-> Client Responsability
The client is responsible for all activity originating from the account unless proven to be a victim of outside hacking or address forgery. The client is responsible for securing their username/password. The client assumes responsibility for all material on their site, and material that may be put on by a third party (such as the usage of Free For All links pages). Use of Slick-Click Limited service requires a certain level of knowledge in the use of Internet languages, protocols, and software. This level of knowledge varies depending on the anticipated use and desired content of the web space by the client. The following examples are offered: Web Publishing: requires knowledge of HTML, properly locating and linking documents, FTPing Web contents, Graphics, text, sound, image mapping, etc. FrontPage web publishing: knowledge of the FrontPage tools as well as Telnet and FTP understanding and capability. CGI-Scripts: requires knowledge of the UNIX environment, TAR & GUNZIP commands, Perl, CShell scripts, permissions, etc. Mail: a use of mail clients to receive and send mail, etc. The client agrees that he or she has the necessary knowledge to create and maintain their web space. Client agrees that it is not the responsibility of Slick-Click Limited to provide this knowledge or support outside matters specific to Slick-Click Limited servers.
-> IP Numbers/Addresses
Slick-Click Limited maintains control and any ownership of any and all I.P. numbers and addresses that may be assigned to the client and reserves in its sole discretion the right to change or remove any and all IP numbers and addrfesses.
-> Limitation of Liability
Slick-Click Limited shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from Slick-Click Limited servers going off-line or being unavailable for any reason whatsoever. Further, Slick-Click Limited shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of Slick-Click Limited servers. All damages shall be limited to the immediate termination of service.
Slick-Click Limited shall be the sole arbiter of what is and is not a violation of these acceptable use policies. Slick-Click Limited reserves the right to terminate an account at any time and for any reason that causes harm to any of Slick-Click Limited customer web sites. Slick-Click Limited reserves the right to delete all content and files upon termination. Slick-Click Limited reserves the right to withhold any pre-paid funds for any site removed for violations of these policies. Slick-Click Limited reserves the right to refuse, cancel, or suspend service at our sole discretion.
-> Payment
Clients have the right to cancel services without charge within 30 days of the service implementation date. At the initiation of a new service Slick-Click Limited will issue an invoice to cover the cost of the service during the first service term. If invoices remain unpaid for more than 30 days we reserve the right to cancel the service. On going services will be invoiced each time a renewal falls due, unless a service cancellation notice has been received. Services for which renewal invoices remain unpaid for more than 30 days maybe terminated at the discression of Slick-Click Limited.
Clients may give notice of termination of an internet hosting contract at anytime. Slick-Click will endeavour to unpublish and remove client information from the internet as quickly as possible. But this process may take some time to complete. No refund will be made of any portion of a prepaid hosting contract when that contract is terminated by the client prior to the contract end date. Where contracts are of a continuing nature Slick-Click requires clients to give at least 1 calendar months notice prior to the planned contract end date to avoid issue of renewal invoice.
